Well on my way there. Never ridden on east or the bike I'm goin on. I picked up an sv yesterday. Bone stock besides the body work. I'll be slowing it up that's for sure. I haven't rode for half a year or more. Racing is a maybe right now for Sunday.

Don't blame it on the tires. I'm kidding. Those are some good times. Real good times. Those are laps that would get you to the expert class really quick if you raced here.

Cant afford CCS, but thanks man. that boosts my confidence a bit, not being cocky but i know my slow spots and those would be taken care off if i was rocking new-ish-er tires ya know... i hated diving into every turn, second guessing my tire wear and capabilities. I really hope i can turn some fast times at arroyo and learn alot, hopefully maybe possibly be able to pick up some sort of sponsorship and win some contingency to help with costs.

Thanks for those who came out to support "club racing"!! :goodjob_sign:
Even though it was still raining before sunrise, the day turned out to be near-perfect racing conditions.
The water "dusted" the track for us, dried out relatively quickly, and the day turned out perfect for racing.
Only one downed rider during the practice sessions due to slick/wet conditions,
otherwise lap times by noon were blazing!
I love watching the GP guys tear up that track!
Came away with two amateur second places and one fourth, one off-track dirt excursion,
and otherwise had a blast and even made it home in time for the Stupid Bowl  :bored:

It was good watching you race Craqhead. I initially didn't know why there was that gap between races, but I found out they cancelled that Pirelli 600 race. I had to leave during lunch, but it was nice to see some good racing.
It hit me while I was watching the races that Bucher wasn't there anymore. It's weird not seeing the number one plate dominate the races and be able to just pull away.

I agree, it's sad not seeing him out there anymore, but he got the fear of Jesus put into him by that wreck on East last year. I spoke to him back in Nov/Dec, and he just told me that the crash and its aftermath caused him to re-arrange his priorities and rethink his racing "hobby". I certainly respect his decision, but am sad to see him go, he was such a good example of skill and commitment to be the best he could be out there.
They keep cancelling the Pirelli race and qualifying because there's not enough riders committed to it. In order to run the race, they must have 6 riders minimum, and there was only one. It really throws off the schedule out there..
I guess Pirelli just ain't that popular on the local circuit as a race tire, or the contingency ain't enough.

Wheeliest - congrats on the track experience bro. Good to read up on your accomplishments and Im glad you're rippin it up. I really hope to join you guys in the near future. With the new job, I can surely pick up another track bike, but finding the time to race is another dilemma. I sure have missed the track riding since the move from CA - lets hope that changes soon!

You're using it without my permission? :47:
You know why you have a pic that makes you look gangsta? Because I'm a long time trackday rider and instructor and I wanted to provide a way for my fellow riders to get some cool pics of themselves. So I went out and invested a shitload of money in equipment, software and time to learn and be able to make you look gangsta. Then I spent even more time and money buying and setting up a website to make it easy for you to view and to purchase your photos. Then I even went so far as to keep my logo out of the way so you can easily see just how gangsta you look. And then, because I like to look gangsta as much as the next guy, but I don't make a crapload of money either, I made it CHEAP to buy your gangsta photo of yourself, so you can display it proudly, and not steal it from another fellow rider. $5 gets you a 1024x768 copy of your gansta self, you don't have to crop out my logo and you can feel good about yourself at night. For a lot less than other pro photographers ask, you can buy the full-resolution image and print a big-ass poster of your gangsta self.
Something to think about.
That rant over with, I'm surprised to hear that's your first time on East. 1.01s is nothing to sneeze at for sure. Decent body position too, though ideally you need to bring your head and torso farther inside.

I'd take your advice if i was trying to break record times.I was riding at a comfortable pace in a comfortable position. no close calls and bike was stable. thanks for your input though...Another great thing to tell people i pit with. your def the kind of fellow rider i look forward to buying photos from.

First off, I may have come across a little harsh, but then I assume the vast majority of adults understand that taking a picture off a photographers website and using it without permission is theft. It doesn't matter if you are in it, if you gave permission to be in it, or whether it is viewable by the public. Spend ANY time reading about copyrights, why they exist and what the laws are.
Besides, according the enthusiastic email you sent me, you couldn't wait to see your photos! You wanted me to post them.
So, apparently you don't know anything about copyright law. That's cool - all you would have had to say is, "Crap, sorry man - I didn't realize that. I'll take the pic down/send you some cash when I can."
Ok, to address your points:
1. The watermark is intended to be a theft-deterrent. That's why nearly all professional photographers put it there. Most photographers obscure the rider with their watermark, but I didn't so you could see yourself better and hopefully help you make the decision to buy.
2. 95% of the riders out there at the track (I know because I know 95% of them) consider it very cool to have someone out there who can take decent pictures of them...oh wait, you did too before I confronted you about this.
3. How much money you put into your bike and trackday, and frankly how much money I spent on my shit is immaterial. By law, you used the photo without permission, and that's theft. No two ways about it.
4. Photographers budget? Did you read my post? I intentionally set the price at $5. FIVE BUCKS! For a web image so broke-ass riders like you and me could afford to legally have a cool photo of you.
and its NOT stealing but thanks for calling me a thief. ill be sure to let the family i pit with know im a thief because i used a photo that was viewable by the public.

I didn't call you a thief, I called what you did (accurately) stealing. There's a difference.
You dont even know me hows it a surprise?.. i've only been on a track a handful of times.
Its a surprise because most riders who aren't racers don't go that fast their first time on that track. It was a compliment.
PS: Any private message sent to me about this matter will be made public. you had no problem confronting me on the public boards so lets keep it that way.
No worries! I confronted you in public because you were the first person of the dozens of riders out there that I found was violating copyright law. If anybody else didn't know/didn't care, they now know and hopefully care.

hmm, I'm thinking that maybe I shouldnt post this but I'm bored...
Dean, please be aware that in no way is this post condoning the use by Jason of the photograph you took and posted on your business website, but I see a certain fallacy or double standard in your complaint and since Rob seems to jump all over Jason for his disregard of your copyright, or basically theft, I figure I might point out what I find wrong with your posts/profile.
You yourself stated in this thread that You know why you have a pic that makes you look gangsta? Because I'm a long time trackday rider and instructor and I wanted to provide a way for my fellow riders to get some cool pics of themselves. So I went out and invested a shitload of money in equipment, software and time to learn and be able to make you look gangsta. Then I spent even more time and money buying and setting up a website to make it easy for you to view and to purchase your photos.
So basically in your intro thread and this thread you have explained your business, investment, and reasoning behind it which I have no problem with. I enjoyed thumbing through your picures on your site and think that your experience on the track and on a bike gives you pretty good insight as to where to set up for your pictures. I do however see a certain, um, double standard, does anyone else maybe?
You agreed to a set of rules when you built your profile here on DR, a site which has quite a considerable amount of money and time vested into it by small group of people. In the rules upon signing up, the same rules that you clicked to abide by you stated that you would not post up advertisements, yet your username and your signature are both advertisements to a business you operate, a business that does not contribute to the operating costs incurred for this site. Jason's use of a $5 photograph is wrong in whatever legal standpoint anyone takes, but isnt your username and website posted in your signature of every post also considered theft in the form of free advertisement that you agreed not to do when you signed up here?
Just food for thought... :72:

Who gives a crap about what the majority of adults do? A lot of people do shit that's illegal - does that in any way make it OK for you to do it? Come on.
People that download music illegally or use torrents are not stealing from me, but since you mentioned it, I stop it all the time. That's one of the things I do at work - I prevent my company from being exposed to legal liability by (among other things), stopping music downloading, sharing and file sharing. I didnt steal anything. its not in my possession. can you PROVE in any shape/form that I cropped it? i uploaded it? i simple pasted a link and you dont think its disrespectful making fun of me saying "gangster" and you chopping it to "gangsta" like im some fuckin wigger? did i say "gangsta" Fuck no i didn't. you came on here making fun of me and accusing me of stealing when you actually have no proof of your accusation. if i printed it and handed it out maybe that would be stealing. And last but not least, no where on your site does it say your not allowed to use photos, it says u can purchase quality photos. stick to policing the company you work for, not public forums.

Yes, it is OK with me to post a link to your photo on my site. In fact, I encourage it. People can then see the other photos there and that will perhaps generate some business for me, either now or in the future.
Thanks for asking.
Ok, if this is something you encourage what the fuck is the big deal of Jason posting that picture? He didnt crop out your company water mark, so anyone that looked at the picture could see who took it. Plus this thread probably attracted alot of attention to your site from all the DR that are enjoying the bitching of Jr High school girls. I could see if he cropped your water mark out completely, and mass printing the photo would be stealing. But he copied and paisted onto a fucking forum, which would be the same as posting a link to the picture like you did with one of the pics, except i didnt have to click on that link to view the picture.

And does anyone really think I need to be a cop to ask you to not use my shit without my permission?
No, you don't have to print and distribute my photos to be stealing. The law VERY CLEARLY states it is illegal to do precisely what you did without my permission.
Did I give you a bit of shit when I first posted? Yeah, I did. I wasn't happy about your hacking up my watermark and posting my photo, especially after you made it a point to email me and tell me how excited you were to see them. So I was pissed and that came through in my post.

I looked over your site and didn't see anything about copyright etc except at the bottom of the page.
So jason screen shot'd the photo from the website and saved it on his comp. Photo is gone, but I remember the water mark still being there. So he's not taking credit and not making any money off the photo. I don't see this any different as taking a newspaper, clipping out a picture or article, and saving it at home. I can see how it completely changes if he crops or photoshops the watermark out, but he didn't do that. someone enlighten me.

He did crop it out - I sure as hell can't tell what the website is from that photo he posted.
And it is not the same. He neither posted a link to my site nor gave me credit of any kind.
It is, unequivocally, stealing. It simply isn't even open to discussion.
Look, if Jason had been cool about it, it would have been over with instantly. Ryan handled it correctly. Jason did not. He's being an ass about it, and I'm just responding, quite politely and with facts to back me up.
I suppose if you were an artist and you posted your work for sale on the Internet, and some yahoo decided to download it and use it for himself with no credit or compensation, you wold just let him?

He cropped out a lot of the watermark (see attached), but that's not the point. The watermark is there to help discourage theft, it is not part of the legal issue.
You're allowed to go look at the picture, but you're not allowed to distribute it or use it. You can take that newspaper picture home and hang it on your wall, but you can't post it on the Internet, scan it and use it in a flyer you make, make copies and give them out to your friends, etc. But here's something to think about. The newspaper has purchased that photo from the photographer (or hired him to take it). The newspaper has bought the rights (or some rights, depending on how the licensing is set up) to use that photo. In any case, the photographer has been compensated for his work.

Posting it with or without watermark violates copyright law. Hacking the watermark off is just adding insult to injury.
so he could make a copy of it and keep it at home, but once he posted elsewhere on the internet, then he was in the wrong?
when the newspapers buy photos, then they own the rights to them correct? same as if we buy photos from you, we then own the rights to them?
If you do ANYTHING with my work other than viewing it how I posted it, you are violating copyright law. Keeping it at home is personal use. Its wrong, but it's harder to catch you, obviously.
I could do like many, many photogs do and obscure your photo with my watermark to discourage this, but I am trusting in my fellow riders to do the right thing and compensate me for my time and effort. Did I mention you can have a nice sized pic to post to your heart's content for $5? Holy shit, that's less than a Happy Meal. That's another reason I was pissed. C'mon, I'm asking $5, but you still gotta steal it? Really?
When the newspapers buy a photo, in some cases they employ the photographer, so the photos he takes all belong to them already. If say the Republic prints an Associated Press photo, they have to buy a limited license from the AP which specifically spells out what they can and cannot do with that photo.
Same thing for me. When you buy a photo from me, I grant you a limited license to use the photo for certain things. You cannot, for instance, buy my $5 web photo and then use it to advertise yourself or make money off the image. I have a license that will allow you to do that, but the cost is different and you get a much better image file.

U.S. Copyright law is and always has been a balance between the rights of original creators and the rights of the public and subsequent creators to use copyrighted material. No one person ever has absolute rights under the law to control every use of a copyrighted work. This applies to you, me, Lane, Disney, Google -- everyone. For example, anyone can take a snippet of this blog post and copy it into their own blog post or email for the purposes of commenting on what I have to say. They can do this without my permission and without even attributing it to me or providing the URL. (Whether they should attribute and link, OTOH, is an ethical matter discussed below).
This balance is codified in the Copyright Act in Sections 106 (http://www.law.cornell.edu/uscode/uscode17/usc_sec_17_00000106----000-.html) (exclusive rights) and 107 (http://www.law.cornell.edu/uscode/uscode17/usc_sec_17_00000107----000-.html) (fair use). Section 106 says that reproduction and display of another's copyright image can be infringement (I tend to avoid terms like "theft" and "stealing" as they generally do not map well (http://papers.ssrn.com/sol3/papers.cfm?abstract_id=582602) to nonrivalrous concepts like intellectual property) and therefore illegal. However, Section 107 tells us that "notwithstanding Section 106", there are certain kinds of reproductions and displays that are fair use and therefore, not an infringement or illegal -- even when used without the permission or attribution of the copyright owner. Such uses include but are not limited to parody, criticism, commentary, news reporting, educational use, etc. To determine whether a particular use is a fair use, courts look at four main factors, including (1) the purpose of the use, (2) whether the original work was published and/or fictional, (3) the amount of the work taken, and (4) the potential harm to the market for the original work. Factors 1 and 4 are generally considered the most important.
So what would a court think of the Bubble Video's use of Lane's photo? Hard to say for sure, but in the end, it probably is a fair use. On the one hand, the Video does use Lane's photo without permission or attribution. Plus, this is how Lane pays her rent. She takes and licenses photos for a living. Uses like this, if they were to become widespread, could potentially undermine her livelihood and thus, her ability to take photographs like the one used in the video. Thus, there is an argument under Factor 4 that this is not fair.
However, the other three factors probably weigh in the Video's favor. First and foremost, what The Richter Scales did was what copyright law often calls "transformative use" -- using other people's copyrighted works in a new way that adds creativity and cultural value. And while perhaps not a direct parody of Lane and her specific work, the inclusion of the photograph in the video was part of an overall commentary on the world that Lane photographs and the people in it. One could even argue that Lane is a part of that world herself and thus, implicitly part of the subject matter TRS intended to comment on. (Note: I haven't talked to TRS, so I have no idea what they intended). Some courts have found fair use in similar cases involving Barbie dolls (http://www.ncac.org/art-law/sum-mattel.cfm), use of concert posters in a book about the Grateful Dead (http://www.devil-riders.com/vb/fairuse.stanford.edu/primary_materials/cases/GrahamKindersley.pdf), the Mastercard "Priceless" ad campaign (http://lawgeek.typepad.com/lawgeek/2004/03/nader_wins_pric.html), a Family Guy parody (http://www.thesmokinggun.com/archive/years/2007/0316072carolburnett1.html) of Carol Burnett, and 2 Live Crew's cover of Roy Orbison's "Pretty Woman." (http://en.wikipedia.org/wiki/Campbell_v._Acuff-Rose_Music,_Inc.) Of course, other courts have come out differently, such as one decision over the use of Dr. Seuss-like rhymes in a book about the OJ Simpson murder trial (http://www.virtualrecordings.com/seuss.html). Still, overall, I think a court would find the video transformative and thus, that Factor 1 weighed in its favor.
I honestly could care less for sides on stupid shit like this, its just entertainment that gets me though the work day so thanks for that. But according to this article, it would be very hard for you to win your case due to section 107. I am not saying it isnt Illegal, but at the same time if you didnt want people to copy and paste and slightly crop your pictures then dont have a link on each picture that says "share picture" all someone has to do is right click any of your pics, hit the share picture button. I am glad you two are finally over this cat fight, but sad to see it go with still an hour left at work :59:

Maybe a little late on the subject (can thank work for that) but Im going to throw my two cents in....
Ive been in the web design business for almost 10 years now and have built upwards of 500 websites ranging from full blown ecommerce sites for multi-million dollar companies, to personal photo galleries and family blogs. Jason, what you did was wrong. Dean watermarked his photo to "protect" his work. Take it from someone who has extensive knowledge and experience in this field - linking, printing, saving, cropping, editing someone else' work in ANY WAY SHAPE OR FORM is illegal without the consent of the photographer/creator/designer. Granted, Im sure you were just stoked about the photo and wanted to share your excitement with your bros, but put yourself in Dean's shoes for a moment. He has gone out of his way to create a photography business, invest his hard earned money to purchase equipment, and use his own personal time to take professional pictures of people like yourself. Yes, Dean could have opened the discussion with a more professional tone, but he was upset. If I ever caught someone stealing my work I would almost certainly react in the same way.
Try to view the situation beyond your hateful, sarcastic perspective..it may surprise the hell out of you!
If I may throw in one more request...You're still VERY new to the track scene. I'm glad you're tearin shit up and having a blast, but try not to make any enemies along the way - especially fellow track riders. Respect goes a long way, and will only open up more doors for you in the future.
Keep it real, gangster.

Dude, your beyond lack of respect for anybody that happens to disagree with you on this board is getting old. The fact that you set up trackdays or help people out is becoming less relevant by nearly every post you make. I have heard from multiple people that you are a really good guy in person (including our own moderators) but frankly, you are a complete asshole on here. Either chill out or get out. You have been given multiple opportunities to correct the behavior. Your choice but we are not going to ask you again.
