Alright i wont post all that happened today as it is up to others to share.
I was following behind one of the newer guys that has only riden to south mountain with us. For LEGAL REASONS im not posting details of how it happened. I ended up t-boning his bike as he was turning off into a parking lot on the way out from tortilla flats. I hit him and went over the handle bars and flew about 10-15ft and just rolled. I had helmet, boots, jacket, and jeans on. I have one cut on my leg and a big ass swollen bruise on there too probably from the bars.
My bike hit his right where the sprocket comes from the transmission. My headlights are toast, all my plastics and tank are rashed/cracked, my speedo and tach are cracket, fairing stay is in a million parts, windscreen is gone, entire right clip on is busted up, passenger seat is busted up, ect. But my frame sliders did save the engine and frame. They worked exactly how they were supposed to. I have the ones where you have to cut...
In the end he ended up getting ticketed for several things, not me. Im going to talk with my insurance tomorrow and see what i can do and what will happen. He doesnt have insurance... and no i will not reveal his name,

That's a shame man. I really hate hearing stories like these. I hope you are ok above all, and of course your bike (you think its salvagable?). I almost went on this ride, but had a weird feeling about it, I'm glad I stayed home now.
How can people not ride with insurance? This still puzzles me, my bike is a whopping $45/month for full coverage, that's chicken feed compared to my truck and Audi. Anyway, I hope everything works out so you don't get screwed.

ill keep you guys updated. Recently i got into it with my dad and he lowered my insurance to liability from full... so we will see what happens with that. If i have the full still then insurance will go after him for the $$$. If i have the liability then I have to go after him for the $$$ which probably means court... this is going to suck but i will be back on soon.
The other guy had a broken lower leg. He was also riding on a suspended license, no registration, and obviosuly no insurance. I feel bad for him and his situation, but honestly he could have done a lot to avoid it. Right now SV Jello and i are working on finding out where he is and how he is doing. All i care is that he is good, beyond that the feelings are a little harsh, but im more then willing to see past it

Did someone said four bikes? All in one ride? wow.... that scares the hell out me. Never been to Tortilla Flats, but by the way it sounds its a place you dont want to F around. Sorry to hear about your accident Blue Devil (dont know your name) hope everything turns out for the best. Keep us updated bro

dont be scared of tortilla. The bad accident actually happened on a straight road, not the twisties. Just ride intelligently and at your own pace.

I'm not scared of my riding, l afraid of other traffic :) most drivers turn stupid on blind corners and sharp turns (I had some pretty close calls). But you are right, you just have to be smart and extra cautious.

I understand that but it all depends on how everything goes down. If my insurance does it my bike will probably be totalled. If that happenes ill probably buy it back and part it out and buy another r6 at the same time. If my insurance doesnt and i have to go after the guy for the repair money and it will get fixed.

if insurance pays for it buy it back and spend $300 on ebay, put the bike back to brandnew w/ upgrades, and pocket the rest
Blue Devil

oh it will cost much more then $300... the headlight alone is like 200 used and the tach and speedo are another 200 used... thats just the beginning

the faring stay is about $150, and you can find all the plastics cheap if you look a little, plus with the $$ you could upgrade suspension, clip ons, etc
just my thoughts though

again, just my opinion but if insurance does pay for it go to a dealer get a crash estimate done, then get insurance to cut YOU a check do the work your self and make some $$

If it has to be a documented sale then i will go for OEM from the dealer,
if u have to go this way let me know.. i know someone who works with insurance companys who can get aftermarket parts cheaper then OEM stuff (insurance companys would rather pay less money right??) and still document everything for ya.

You need to get a quote to repair the bike and keep your medical bills. If, and it probably will be more, less than $1500-2500, it can stay in small claims court. If over $1500, I think that is the limit for small claims court you will have to sue him in civil court. You need to keep track of everything, time lost at work because of the wreck and time lost preparing your law suit, filing paperwork, med bills, bike repair cost. You can claim anything you want just keep in mind the Judge will make the decision if it is reasonable. I have played this game twice and her is the kicker. You can win in court and still never see a dime. Unless you are willing to play the game to the end. You will have to find out where he/her works and garnish his/her wages. Garnishment means more paperwork and possibly you following him/her to work to find out where to serve him/her. Depending on how much money you are looking for will determine how long it takes to pay you off. If he/her changes jobs often you have to keep tracking them down and filing more garnishment paperwork. Good luck. Personally I loved F***ing with the dickheads I sued.

yea i dont want to go that route though. Hopefully he ownes up to what he has to do, the police report says he is wrong, so his insurance is responsible for fixing my bike. Because he has no insurance, he is responsible.
Blue Devil
09-20-2006, 02:11 PM
If i were to try and help him out by keeping it in small claims court would i still have to track him down to pay like i would if i sued? I really dont want to get that deep into the situation, i just want the damn money for used parts for my bike, is that so unreasonable?
So if i go through small claims how would i go about getting paid?
TeamMaico
09-20-2006, 02:29 PM
Yes, even if you win in small claims court he does not have to pay you. You will have a judgement against him. If you want the money you may have to go get it the hard way. If you have to go to court chances are he is a man of no integrity. If he meets with you and agrees he will pay work out a payment schedule or lump sum agreement. If he breaks the agreement you can finish it in court.
